1. scope of application

These General Terms and Conditions (GTC) govern the use of the bambus.com website, operated by Abuma GmbH, Surseestr. 25, CH-6206 Neuenkirch (hereinafter "Operator"). They apply to all registered users (hereinafter "Advertisers") and visitors to the platform. By registering or using the website, you agree to these GTC.

2. service description

bambus.com is an online company directory for bamboo-related products and services. Advertisers can create entries in various subscription models for a fee (see section 4). The operator reserves the right to expand, adapt or restrict the functions of the platform at any time, provided this does not significantly impair its use.

3. registration and use

3.1 Registration

Registration is required to create an entry. The advertiser undertakes to provide truthful, complete and up-to-date information.

3.2 Access data

The advertiser is responsible for the confidentiality of his access data and may not pass them on to third parties. In the event of misuse, the operator must be informed immediately.

3.3 Contents

The advertiser guarantees that uploaded content (texts, images, videos, PDFs) is free of third-party rights and does not contain any illegal, offensive or misleading content. The operator may reject, block or remove entries without giving reasons, in particular in the event of violations of these GTC.

3.4 Dashboard

After registration, the advertiser is given access to a dashboard where he can manage his entry independently.

4. subscription models and services

4.1 Models offered

Basic: CHF 30/month - Simple entry with 1 category, basic information (company name, address, telephone, website), map function, customer rating option.

Premium: CHF 95/month - Extended entry with up to 2 categories, description (max. 400 characters), 5 images, email contact, telephone, website, address, map function, customer rating option, claim badge, PDF upload (max. 2).

Business: CHF 210/month - Comprehensive presentation with unlimited categories, unlimited description, unlimited images, 1 video (optional), business hours, 1 regular listing, 1 featured listing, contact form, E-Mail, phone, website, address, map function, customer rating option, unlimited PDF upload.

4.2 Additional advertising opportunities

Banner advertising (e.g. CHF 90/week for home page banners) and newsletter presence (e.g. CHF 120/issue for feature articles) can be booked separately.

4.3 Runtime

The minimum term is 1 month. The subscription is automatically extended by one month at a time (auto-renewing) unless canceled 14 days before expiry.

4.4 Upgrade

An upgrade to a higher subscription is possible at any time; the difference will be charged pro rata.

4.5 Availability

Entries are online within 24 hours of receipt of payment, provided there are no technical problems.

5. terms of payment

5.1 Prices

All prices are exclusive of 8.1% VAT (for Swiss customers). International customers pay without VAT, which is shown accordingly on the invoice.

5.2 Method of payment

Payments can only be made by bank transfer. The bank details will be communicated after registration.

5.3 Due date

Payment is due monthly in advance. In the event of late payment, the operator may block the entry or terminate the account following a reminder.

5.4 Reimbursement

Amounts already paid will not be refunded in the event of termination, except in the event of proven failure on the part of the operator (e.g. permanent technical failure).

6. termination

6.1 Advertiser

The advertiser can cancel the subscription in writing (by E-Mail to ) with a notice period of 14 days to the end of the month.

6.2 Operator

The operator may terminate the contractual relationship without notice for good cause, in particular in the event of breaches of these GTC, late payment or illegal content.

6.3 Consequences

After termination, all content of the advertiser will be deleted from the publicly accessible area, unless otherwise required by law.

7. liability

7.1 Operator

The operator is only liable for intent and gross negligence. No liability is accepted for technical failures, data loss or damage caused by third parties, unless this is the fault of the operator.

7.2 Advertiser

The advertiser shall be liable for the legality and accuracy of its content and for any damage caused by misuse of its access data. The advertiser shall indemnify the operator against all claims that third parties may assert against the operator on the basis of the content provided by the advertiser.

8. data protection

The operator processes personal data in accordance with the applicable data protection regulations (see data protection declaration under bambus.com/data protection). Advertisers agree to the processing of their data for the fulfillment of the contract.

9. changes to the GTC

The operator may amend these GTC with a notice period of 30 days. Advertisers will be informed by E-Mail. If they do not object within 14 days, the new GTC shall be deemed accepted. In the event of an objection, the subscription can be terminated at the end of the following month.

10. copyrights and rights of use

10.1 Platform content

The contents published on bambus.com (design, logos, texts of the operator) are protected by copyright and may not be used without the consent of the operator.

10.2 Advertiser content

By uploading content, the advertiser grants the operator a non-exclusive right, limited in time to the duration of the contractual relationship, to use this content within the framework of platform operation.

11. severability clause

Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid clause shall be replaced by a provision that comes closest to the economic purpose.

12 Place of jurisdiction and applicable law

12.1 Place of jurisdiction

The registered office of the operator (Neuenkirch, Canton of Lucerne, Switzerland) is responsible for disputes arising from these GTC, insofar as legally permissible.

12.2 Law

Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
